4. Hardware: Purchase, Rental & Ownership
4.1 Hardware Purchase
When a customer purchases a Qube smart meter, full hardware ownership transfers to the customer upon successful payment of the purchase price. However, such ownership does not include any proprietary software, server-side logic, or access to the recharge platform, which remain the exclusive property of Qube and are licensed to the customer subject to these Terms.
4.2 Hardware Rental
Customers may also rent Qube meters subject to the following rental terms. Monthly rental charges apply for the duration of the rental period, and a one-time refundable security deposit is charged at the commencement of the rental agreement, the amount of which is determined based on the meter model selected. Such deposits are refundable upon returning the device in good condition, subject to inspection by Qube or its authorized representatives. Physical damage, burnt units, tampering, or misuse of the device may result in deductions from the security deposit or complete forfeiture thereof, at Qube's sole discretion.
4.3 Installation Services
Installation services may be provided by Qube or its authorized partners, and additional charges may apply for such installation services, which shall be communicated to you prior to the commencement of installation work.
4.4 Hardware Misuse & Tampering
Any of the following actions shall be considered tampering and shall void the warranty: opening or modifying the device, unauthorized rewiring, bypassing the meter, intentional damage, or use outside recommended electrical standards. Qube reserves the right to levy inspection charges for tampered units, and such charges shall be payable by the customer in addition to any other remedies available to Qube under these Terms or applicable law.

The warranty does not cover physical damage, fire damage, water or moisture damage, electrical surges due to faulty wiring at the customer's premises, tampering with the device, or unauthorized repairs performed by parties other than Qube or its authorized service providers. Extended warranty options may be provided based on customer requirements, subject to additional terms and conditions that shall be communicated at the time of purchase or upgrade.

6.1 Payment Gateways
Payments on Qube are processed via Cashfree payment gateway and direct bank transfers. Qube does not use Razorpay or Stripe payment gateways unless explicitly mentioned in your service agreement or payment documentation.
6.2 Recharge System Policy
All prepaid electricity top-ups made by tenants or occupants are processed directly into the building manager's or property owner's bank account, and Qube acts only as a technology service provider facilitating such transactions. Therefore, Qube cannot process refunds for unused tenant balance, and any refunds, if applicable, must be handled directly by the building or property management team. Qube bears no financial liability for settlement disputes between tenants and property management, and all such disputes must be resolved between the parties involved without Qube's participation.

7. No Refund on Meter Balance
Meter balance recharged by occupants is non-refundable through Qube, as funds are settled directly to the property owner, Qube is not the merchant-of-record for such transactions, and Qube does not control or manage the settlement account into which such funds are deposited. All claims related to unused balance must be taken up directly with the building manager or property owner, and Qube shall have no obligation or liability with respect to such claims.
8. Service Availability & Platform Reliability
Qube strives to ensure that its Services are reliable, that uptime is maximized, and that critical systems operate smoothly. However, Qube does not guarantee uninterrupted service, and temporary disruptions may occur due to scheduled maintenance, system upgrades, network failures, third-party system issues, power outages, or other circumstances beyond Qube's reasonable control. Qube will make reasonable efforts to notify users of scheduled maintenance activities that may affect service availability, but Qube shall not be liable for any losses or damages resulting from such disruptions.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Qube's total liability for any claims arising out of or relating to these Terms or the Services shall not exceed the total subscription fees paid by you to Qube in the three months immediately preceding the date on which such claim arose. Qube is not responsible for property owner mismanagement, wrongful billing practices, or incorrect settlement handling by property owners or their representatives.
